Withdrawal and Refund Policy for Digital Products

1. Scope
This Policy applies to SheetShark digital spreadsheet products, including Microsoft Excel workbooks, Google Sheets templates and related downloadable or electronically accessible content supplied without a tangible medium. SheetShark is operated by Creative Design and Business V.O.F., Bosstraat 90a, 6071 PZ Swalmen, The Netherlands.
2. Statutory Withdrawal Period
Consumers in the European Union and other jurisdictions with equivalent mandatory rules may normally have a statutory period in which they can withdraw from a distance contract. Digital content supplied without a tangible medium is subject to a specific exception when immediate digital delivery is requested.
3. Loss of the Right of Withdrawal After Digital Supply Begins
Where permitted by applicable law, the consumer loses the statutory right of withdrawal once supply of the Digital Product begins, provided that before supply begins the consumer:
- has given prior express consent for supply to begin before the end of the withdrawal period;
- has acknowledged that the right of withdrawal will be lost when supply begins; and
- has received confirmation of that consent and acknowledgement on a durable medium, such as email.
For this purpose, supply may begin when the customer activates a download, starts the copying process for a Google Sheets template, opens granted digital access or otherwise starts receiving the Digital Product after the required consent has been recorded and confirmed.
This rule reflects Article 16(m) of Directive 2011/83/EU and its Dutch implementation in Article 6:230p(1)(g) of the Dutch Civil Code. It does not apply if the legally required consent, acknowledgement or confirmation has not been validly obtained.
4. Before Digital Supply Begins
If the customer has a mandatory statutory right of withdrawal and digital supply has not yet begun, the customer may exercise that right within the applicable period. A request can be sent to info@cdb-solutions.com and should include the customer's name, order number, product and purchase date.
5. No Change-of-Mind Refund After Supply Begins
Once the conditions in Section 3 have been met and digital supply has begun, the customer is not entitled to cancel the order or receive a refund merely because the customer changed their mind, no longer needs the product, has already copied it, expected a different design preference or failed to review clearly disclosed compatibility requirements.
6. Defective, Misdescribed or Undelivered Products
The loss of the withdrawal right does not remove mandatory rights relating to defective, misdescribed, inaccessible or undelivered digital content. If a Digital Product materially fails to match its Product Page, cannot be accessed despite meeting the stated requirements or contains a material technical defect, contact us with the order number, product name, software or browser version, operating system and a description of the issue.
Where required by law, we will provide an appropriate remedy, which may include restored access, correction, replacement, an update, a proportionate price reduction or termination of the contract and a refund.
7. Duplicate and Accidental Purchases
Requests concerning an obvious duplicate transaction or accidental purchase may be reviewed individually. Any voluntary refund offered in such a case is discretionary unless mandatory law provides otherwise and does not create a general right to a refund after digital supply has begun.
8. Customers Outside the European Union
Customers outside the European Union may have different mandatory cancellation or refund rights under the law that applies to them. To the extent permitted by that law, sales of Digital Products are final after digital supply begins. Nothing in this Policy excludes a right or remedy that cannot lawfully be excluded.
